Kathy Green, a spokesperson for the Governor's office, says the court has left the matter "undecided."
"While two justices would have had the Court decide the issue now, the other five justices declined to do so at this point because they believed the governor has 'an adequate alternative remedy,'" she said.
Now, Hickenlooper’s office says it is considering possible next steps.
Attorney General Cynthia Coffman has angered Hickenlooper joining a multi-state lawsuit against the Environmental Protection Agency’s new limitations on carbon dioxide emissions from power plants. The state is currently working to meet the EPA’s rules.
