Fifth Juror Dismissed In The Aurora Theater Shooting Trial

Judge Carlos Samour, who's presiding over the Aurora theater shooting trial, dismissed a fifth juror Wednesday morning.

Samour said that he didn’t feel the juror was completely forthcoming with him after a prosecution witness recognized the juror, who works at her son’s middle school. The juror should have alerted him too, according to Samour.

"It’s clear to me that she recognized this witness and didn’t say anything," he said.

There are now seven alternates left with the trial more than halfway over. The prosecution plans to rest its case on Friday.

James Holmes has pleaded not guilty by reason of insanity for killing 12 people and wounding 70 others in the shooting. He faces the death penalty if convicted.
