The United States Supreme Court is considering a Colorado case in which jurors say a fellow juror made racist remarks about a defendant during jury deliberations.

The case, Pena Rodriguez v. Colorado, involves a man convicted of attempted sexual assault who says he was denied his right to an impartial jury. The case calls into question state and federal laws that prevent people from challenging a verdict based on juror testimony about what happened during deliberations.

Sherry Colb is a professor at Cornell Law School and recently wrote a piece in the on-line legal publication Verdict about the case. She speaks with Colorado Matters host Nathan Heffel.
