Democratic state Sen. Daniel Kagan is resigning from the state legislature.

Kagan has represented a competitive suburban district in Arapahoe County since 2009, first as a state Representative and then as a Senator beginning in 2017.

It was during that legislative session that a workplace harassment investigation found that Kagan likely used the wrong restroom inside the state capitol three times.

The report was completed in early June.

Republican Sen. Beth Martinez Humenik was one of women who filed a complaint, and who released the report to the public in September.

At the time, Kagan admitted that he was in the women’s restroom, but said it only happened once.

Kagan is a lawyer and had made justice issues a legislative priority.

In a statement, Kagan said:

It’s been a great honor to serve the people of Colorado for just short of a decade. An important obligation of leaders, I believe, is to be open to acknowledging that it’s time to pass the torch to new leadership and, for me, that time is now. I am comfortable with my decision, largely because I know that we have no shortage of individuals in Arapahoe County who would do a superb job of representing the people of Senate District 26.
